We always tell our clients that filing bankruptcy should be your last resort.  If you can solve your  financial distress without filing, you should do so.  But if you must file, we can expertly guide you through the process in the Eastern District of North Carolina (generally, the area east of Raleigh).  There are several types of bankruptcy cases you can file:

Chapter 7-- Often called "Straight Bankruptcy", Chapter 7 allows you to retain essential  property and obtain relief from the obligation to repay most debts.  We will assist in preparing and filing your petition and attend court with you.  There is a $299 court filing fee, and our fees under the new law range from $1200 to $1500 in typical cases.  The court fee must be paid in advance of filing.  We will help you figure out how our fee can be paid.

Chapter 13--Often called "Wage Earner Plans", Chapter 13 allows you to develop a debt-consolidation plan, reduce interest rates, reduce your over-all monthly payments, and clear your debts by making monthly payments to the court for 3 to 5 years.  We will review your property, debt obligations, and help develop a workable plan that will give you the peace of mind you need.  There is a court filing fee of $274 which must be paid to the court when your case is filed.  Most of your attorneys fees will be paid as a part of your debt consolidation payments to the court.

Fees have increased as a result of the new law that became effective on October 17, 2005, due to increased work required to file.  We will continue to review our fees and update as we determine how much time will be required in cases under the new law.

Chapter 11--This type of bankruptcy is more often used to reorganize businesses, but  may also be used by individuals who cannot solve their financial problems through a Chapter 7 or a Chapter 13.  We can assist you in analyzing your needs to see if relief under Chapter 11 will help you.  If so, we will represent you and guide you through the entire Chapter 11 process.  Fees for Chapter 11 vary widely, based on the type of case you have.  We will be happy to discuss fees and other costs you may encounter in a Chapter 11 when we discuss your case.

Chapter 12--This chapter is a special one for farmers only.  It is especially designed to allow farmers to reorganize their operations for an opportunity to stay in farming.
